All of the magazine’s defences were rejected and it was then for Justice John Dixon to assess the damages. The Victorian Court of Appeal has ruled that Rebel Wilson’s $4.5 million record damages verdict is no longer the record, rejecting her claim for special damages and cutting the figure down to $600,000.
Actress Rebel Wilson has been ordered to pay $4.1 million back to Bauer Media after the magazine publisher won its appeal to overturn her record defamation payout. The Court of Appeal said Ms Wilson must repay the money, plus $60,316 in interest to Bauer Media. She must also pay 80 per cent of the publisher's appeal court costs. The court found she had missed out on film roles because of the articles, which claimed Ms Wilson had lied about her age, real name and childhood. It found the trial judge had relied on evidence from Ms Wilson and Hollywood agents to draw the conclusion that the actress had lost job opportunities due to the articles. The Court of Appeal said that in awarding compensation for economic losses, Justice John Dixon "relied also upon his assessment of the trajectory of Ms Wilson's career".In its appeal against the decision, Bauer Media argued that the $4.7 million payout was excessive and should be set aside due to errors in fact and law.Ms Wilson will keep a remaining $627,165 in damages from Bauer Media. This service may include material from Agence France-Presse (AFP), APTN, Reuters, AAP, CNN and the BBC World Service which is copyright and cannot be reproduced.Rebel Wilson's record defamation payout dramatically slashed on appeal'Clearly not fair': Wilson to appeal against defamation rulingLive: Man in his 20s becomes Australia's youngest coronavirus victimNSW records nine new COVID-19 cases as nearly 30,000 get testedThe airlines knew the Ruby Princess was a ticking time bomb but were powerless to stop it'Screaming in their sleep like they're being murdered': Ex-soldiers sound alarm on potential COVID-19 drugMan in his 20s among 14 new coronavirus deaths recorded in VictoriaAnalysis: Trump just admitted he's stalling pandemic relief to make it harder to voteEmotional burden of stage 4 restrictions heavier on lone-person householdsNew COVID-19 cases in NSW likely 10 times higher than official figures, expert warnsGhislaine Maxwell faces 'strong likelihood' of many years in prisonApple kicked Fortnite off the App Store and now they're being sued.
Today, the Court of Appeal (Justice Tate, Justice Beach and Justice Ashley) allowed an appeal by Bauer Media Pty Ltd and Bauer Media Australia Pty Ltd (‘Bauer’) against an award of $4,749,920.60 in damages awarded to Ms Rebel Wilson (‘Ms Wilson’ or ‘the plaintiff ’) at her defamation trial against Bauer. Bauer Media argued during the case that the articles in question were not defamatory, but the appeal announced on Monday contests only the payout’s size.
